Today we will get information about gambling law in Gujarat.
What is the law?
The Gambling Act was enacted in 1887.
The law is called the Bombay Prevention of Gambling Act.
The law is originally from Bombay but after the separation of Maharashtra and Gujarat, the law has continued in Gujarat and is now known as the "Gambling Prohibition Act" with amendments.
* What is gambling? *
As per the provision made in Section-3 of this Act, a person commits an offense under this Act by placing a bet or a condition in a contest, or winning a statistic, gambling eye difference, etc.
There are two types of gambling cases in which the law prescribes two different procedures.
Gambling in an open space, on a public road or in a public place or under a tree, on an open agaci or other public place under section 12 (a) can be caught without a warrant by the police.
In short, gambling anywhere outside the four walls can be caught by the police under Section 12 (a) of the Gambling Prohibition Act.
Sections 4 and 5, if a person gambles in a closed room or between four walls, a gambling case may apply to both the gambler and the person who owns the house or property.
A person caught gambling under section 6 (a) refuses to reveal his name or gives a wrong name or gives an incomplete name and address if found guilty is liable to a fine of Rs. 100.
Of particular importance is the provision that under Section 9 of the Act, it is not necessary to prove in court that gambling was done with money in order to prove the offense of gambling.
This means that even if you play without money as per Article 9, it can be considered as gambling.
* Punishment for gambling *
If the gambling case is proved in court or the accused pleads guilty in court, there is a provision of a fine of Rs 500 for the first offense and a maximum imprisonment of 3 months.
Also, if there is a second offense, there is a provision of imprisonment for six months and a fine of Rs 200.
* Bail in gambling case *
Gambling in the open as per Section 12 (a) or gambling in a closed house as per Sections 4 and 5 are both bailable offenses. In case of gambling, bail can be obtained from the police station within a maximum of 24 hours.
And the police also have to grant bail within 24 hours.
Police cannot hold custody for more than 24 hours
The accused arrested in the gambling case does not have the authority to beat the police.
If a person caught gambling is beaten, a written complaint can be made against the police in court or to a superior.
In short, in a gambling case, it is the law to get bail from the police station and the police cannot kill.
